தாது மணல் தொழில் முன்னேற்றத்தில் மத்திய அரசு துறைகளின் பங்கு அளப்பரியது.

இந்தியாவில் தாது மணல் தொழில் சிறந்து விளங்குவதற்கு மத்திய அரசு துறைகள் அவ்வப்போது பல்வேறு செமினார்களை நடத்தி சர்வதேச தரத்தில் இந்திய உற்பத்தியாளர்களும் உற்பத்தி செய்ய பயிற்சி கொடுத்தார்கள். இந்தியாவில் தாது மணல் தொழில் 2002-க்கு பிறகு தான் வளர்ச்சி அடைய ஆரம்பித்தது. அதற்கு காரணம் 2002-ல் பெங்களுரில் வைத்து மினரல் பிராசசிங் டெக்னாலஜிக்கு ஒரு சர்வதேச கருத்தரங்கை மத்திய அரசு துறைகளான Indian Institute of Science, Indian Bureau of Minesஆகியவை இந்திய அரசு நிறுவனங்கள் மற்றும் Indian Institute of Mining Engineers ஆகியவற்றோடு சேர்ந்து நடத்தின. அதில் இந்தியன் ரேர் எர்த் நிறுவனம் மட்டும் அல்ல, அமெரிக்காவில் லெக்சிங்டன் நகரத்தில் உள்ள University of Kentucky போபாலில் உள்ள Regional Research Laboratory ஆகியவை சேர்ந்து தாது மணல் சுற்றுச்சூழல் பாதிக்காமல் இலகுவாக பிரித்து எடுப்பதில் உள்ள தொழில் நுட்பங்களை விளக்கினார்கள். இது தான் இந்தியாவின் தாது மணல் தொழில் வளர்ச்சிக்கு முக்கிய காரணம். அதன் பிறகு கடந்த 15 வருடங்களாக இம்மாதிரி சர்வதேச கருத்தரங்குகள் நடத்தப்படவில்லை. அவை நடத்தப்பட வேண்டியது அவசியம்.

தாது மணல் தொழிலாளர்களின் பரிதாப நிலை


அந்நிய நாட்டு நிறுவனங்கள் இந்திய உற்பத்தியாளர்களின் போட்டியை சமாளிக்க இந்தியாவில் சில புல்லுறுவிகளை வைத்து அரசு அதிகாரிகளையும் ஊடகங்களையும் சரி கட்டி தமிழ்நாட்டில் உள்ள அனைத்து தனியார் தாதுமணல் நிறுவனங்களின் இயக்கத்தை நிறுத்தி வைத்தார்கள். இதனால் சுமார் 50000 தொழிலாளர்களுக்கு மேல் பாதிக்கப் பட்டார்கள். இது சம்பந்தமாக அரசை அணுகும் போது நிழல் அரசு நடத்தும் திவாகரன் கூட்டம் அவர்களது உறவினர்களை மாவட்ட ஆட்சியராகவும், புவியியல் சுரங்கத்துறை இயக்குனர்களாகவும் நியமித்து அரசு ஆற்று மணலை ஏற்று நடத்துவது போல் இதனையும் செய்தால் பெரும் பணம் பண்ணலாம் என்ற எண்ணத்தில் நீதிமன்றத்தில் உள்ள வழக்கிற்கும் இழுத்தடிப்பு செய்து காலதாமதபடுத்தி வந்தார்கள். இதற்கு காசுக்கு விலை போகும் சில ஊடகங்களும் உடந்தையாக இருந்தன. நீதிமன்றத்தின் கதவை வழி இல்லாமல் தட்டிய நிறுவனங்களுக்கு வருட கணக்கில் நீதி கிடைக்காமல் வழக்குகள் நிலுவையில் உள்ளன. நீதிமன்றத்தில் விரைவில் வழக்கு முடிந்து விடும் என்ற நம்பிக்கையில் தொழிலாளர்களை வேலை இல்லாமலேயே முழு சம்பளம் கொடுத்து விவி மினரல் நிறுவனம் இது வரை பாதுகாத்து வந்தது. தற்போது எப்போது இந்த பிரச்சனைகள் முடியும் என தெரியாத நிலையில் பிரச்சனை முடிந்த உடன் வேலைக்கு வாருங்கள் என கூறினார்கள். சில பணியாளர்கள் எங்களுக்கு முழுவதும் செட்டில் செய்ய வேண்டும் என கோரிக்கை வைத்தார்கள். அதற்கும் நிர்வாகம் ஒப்புக் கொண்டது. விண்ணப்பம் சமர்பிக்கும் நபர்களுக்கு முழுவதும் செட்டில் செய்யப்படும் என அறிவித்தது. 

தற்போது ஒரு தொழிற்சாலையில் உள்ள பணியாளர்கள் மட்டும் இது சம்பந்தமாக வீதிக்கு வந்துள்ளார்கள். முந்தைய மாவட்ட ஆட்சியர் செய்த தவறு தற்போதைய ஆட்சியரால் திருத்தப்படவில்லை. அரசும் இதில் தலையிட தயாராக இல்லை. ஒரு செயற்கையான நெருக்கடியை கொடுத்து பணம் பறிப்பதிலேயே அரசியல்வாதிகள் குறியாக உள்ளார்கள்.  தொழிலாளர்களின் பாதிப்பை அரசின் கவனத்திற்கு கொண்டு செல்ல அனுப்பப் பட்ட புகார் மனுக்கள் எந்த பலனையும் தராத நிலையில் அரசு தலைமை செயலர் திருமதி கிரிஜா வைத்தியனாதன் அவர்களை சந்திக்க நேரம் ஒதுக்கி தர தொழிலாளர்கள் சார்பில் மனு அனுப்பப் பட்டது. ஆனால் எந்த பதிலும் இல்லை. 

எனவே தொழிலாளர்கள் வீதிக்கு வரும் நிலை ஏற்பட்டது. தற்போது தொழிலாளர்கள் ஒரு தொழிற்சாலையில் உள்ளிருப்பு போராட்டத்தில் ஈடுபட்டு வருகிறார்கள். இதற்கு காரணம் தொழிற்சாலை நிர்வாகம் அல்ல. அவர்கள் தொழிற்சாலையை இயக்குவதற்கு தயார். ஆனால் மாவட்ட ஆட்சியரின் தவறான உத்தரவு தான் இந்த தொழிலாளர்கள் பாதிக்கப்பட காரணம். எனவே தொழிலாளர்களுக்கு அரசு சம்பளம் வழங்க வேண்டும் அல்லது தொழிற்சாலையை திறக்க அனுமதிக்க வேண்டும்.

Beach mineral mining ban shatters lives

Tirunelveli: While the Prime Minister pushes his pet ‘Skill India’ campaign for delivering 400 million skills-trained workforce by 2022 to turbo-charge employment generation and economic development, the reverse is happening down south Tamil Nadu.
The four-year ban on beach mineral mining has robbed the employment of over 15,000 skilled youths, who are now battling hunger by turning to menial jobs in the drought-hit Radhapuram region of Tirunelveli district. Apart from such personal agony for these many hapless families, the huge loss to state exchequer by the freeze on its royalty income from the mining could badly hurt its budget planning; not to mention the big dollar losses by derailed exports as the region contributes over 70 per cent of India’s heavy mineral share in the global market.
ITI-qualified Balamurugan of Naalumavadi village had been working in the transport section of a leading garnet processing and export plant at Vallanvilai (Tirunelveli district) for about 10 years when the mining ban hit his company in September 2013. Now the 30-year-old father of three kids has ended up as a construction worker.
“My two sons and a daughter were going to an English-medium school when I was in the company drawing over Rs.15,000 a month. Now they go to a government school because I cannot afford to pay fees. I am just managing to keep them off starving with my meagre income”, Balamurugan told Deccan Chronicle.
MBA grad C. Venkateswaran, 33, of semponvilai, was earning Rs.25,000 a month in the marketing department of a busy beach mineral company but after the ban brought the shutters on the factory, the polio-stricken man is now driving an autorickshaw at Thisayanvilai bus stand to feed his family.
Vetrivel, 32, was taking home a salary of Rs.13,500 working as driver at a beach mineral company. Now a pavement dweller in Chennai, he earns just enough to save the family back in the village from hunger. The mineral company used to provide healthcare for the family but now the medical bills of his aged parents are daunting. “I hope the government lifts this ban and I get back my job”, says Vetri sporting a vacant look.
Dozens of such sad stories fly at the face as one steps into this dark zone that was so full of life and all-round development just four years ago. Murugan, 22, an automobile diploma holder lost his job in the body-building section of a beach mineral company and is now a woodcutter, chopping down the thorny ‘seemakaruvelam’ shrubs. “This wood is supplied to the carbide units near Ottapidaram. I get four rupees per kilo of wood”,  Murugan said.
Krishnammal, 50, managed to educate her daughter even after her husband deserted her when the girl was barely three months old. The mineral company where she had worked took care of the girl’s bills. “My daughter is now in the final B.Com and I must turn to private lenders to pay her fees”, says Krishnammal, also expressing disappointment that her dream of securing an administrative job for her daughter in the company crashed with the mining ban.
Like Krishnammal, many women have been badly hit by the ban and the closure of their factories. Rajeswari, 52, used to earn over Rs.10,000 a month in a factory but now is rolling beedies to feed the family as the factory is closed and the husband is paralytic.
While the mining ban rendered thousands jobless in the coastal districts of Tirunelveli, Kanyakumari and Thoothukudi, the region has turned into a ‘fertile’ ground for private money lenders. Also, the steep fall in incomes and purchasing power among the locals has badly impacted all businesses and trade here.
Tirunelveli CITU secretary Mohan says a huge human tragedy is emerging out of the beach mining ban. The workers could move the courts for remedy, he says.

State coordinator of Naam Thamilar Katchi, Viyanarasu, strongly came down upon the state government for continuing the ban disregarding impact on the workers’ livelihood. “This blanket ban in the name of regulation is just not fair. What about the welfare of these poor workers?” he asks.

தாது மணல் சம்பந்தமான வழக்கு உயர்நீதிமன்றத்தில் விரைவில் விசாரணைக்கு வருவதை அறிந்து நீதித்துறையில் எதிர்மறையான கருத்துக்களை உருவாக்குவதற்காக அந்நிய போட்டி நிறுவனங்கள் இங்குள்ள சில ஊடகவியலாளர்களை கையில் வைத்து அவ்வப்போது விவி மினரலுக்கு எதிராக பொய் செய்திகளை வெளியிட்டு வருவது போல் தற்போதும் ஒரு பொய் செய்தியை வெளியிட ஏற்பாடு செய்து இது சம்பந்தமாக நான்கரை மணி நேரத்திற்குள் பதில் வேண்டும் என கேட்டு ஒரு மின் அஞ்சல் அனுப்பப் பட்டது. இதன் பின்னால் இதற்கு என ஏற்பாடு செய்யப் பட்டுள்ள சந்தியா ரவி சங்கர் இருக்கிறார் என தெரிந்தாலும் ஊடகவியலாளர்கள் என்றால் நீதித்துறையும் அஞ்சத்தானே செய்யும். ஆயினும் தொழிலாளர்களின் நலனை காக்க உடனடியாக சில விபரங்களை கேட்டு ஒரு மின் அஞ்சல் அனுப்பினேன். அதில் மாவட்ட ஆட்சியர் திரு.கருணாகரன் செய்த சட்டவிதிமீறல்கள் பற்றி குறிப்பிட்டு இது பற்றி நீங்கள் கேட்க தயாரா என கேட்டு இருந்தேன். விவி மினரலுக்கு எதிராக எழுத வேண்டும் என நியமிக்கப் பட்டவர்கள் எப்படி இந்த அதிகாரி செய்த தவறுகளை கேட்பார்கள். எழுதுவார்கள். ஆயினும் அவரிடம் இருந்து வந்த மின் அஞ்சல் அதற்கு நான் அனுப்பிய பதில் தொழிலாளர்கள் தெரிந்து கொள்ள கீழே கொடுக்கப் பட்டுள்ளது.

Sir,

In fact this is issue is dealt with our company Managing Director Mr.S.Vaikundarajan. So he can alone give the correct reply. If you want, you can send mail to him and he will reply with in two days.

On seeing your urgency, I can judge that you have already prepared the story against VV Mineral for the commitments made by you with some persons. So, I  know whatever reply we furnish, you will publish the news only against VV Mineral. Because for that purpose only you have been paid by our competitors according to my information.

You have speak about the district committee decision. If you ask the District Collector whether the district committee issue show cause notice against VV Mineral, as requested by their letter dated 12.10.2016,  if so where is the notice?, which date ? what are the violations  put forth against VV Mineral, Which date it is served? what is the reply received from VV Mineral? on which date you give personal hearing to VV Mineral as requested by them on 12.10.2016? you can find out that, the District Committee particularly Collector M. Karunakaran colluded with Mr. Thangamuniasamy, DD Mines, violated the law, rule every thing. This is only to help the media persons like you to publish false news against VV Mineral, to prejudice the judiciary .

I am attaching herewith copy of G.O. 179 in which the district committee is constituted. If you go through the G.O. the District Committee has the power to enquire appeal if it is filed within 30 days. Whereas in this case, without appeal and without any specific complaint against VV Mineral , the District Committee, at the instigation of Collector Karunakaran decided against VV Mineral without any jurisdiction or any statutory power. No powers have been given either to the District Committee or to any other state government officers to set aside the royalty settled accounts in respect of major minerals. This can done by the Central Govt., Mines Tribunal alone. You can find out the same in section 30 of the MMDR Act.

Moreover if you go through the MC Rule, Rule 2(c),  if the mining is carried out in a non-lease hold area, then only it amounts illegal mining. Excess production does not amounts illegal mining. You can find out the parliament reply. Copy attached.

Any how Collector Karunakaran and Thangamuniyasamy, DD Mines also colluded with people like Sandhya Ravishankar , only to damage VV Mineral reputations, they have cooked the illegal minutes. I think our company may take legal action against the same. If you need any further information, you may contact our Company MD Mr. S.Vaikundarajan or our company advocate Mr. Srinath Sridevan. They can alone give you a clear reply.

Anyhow, though I know that, you have prepared a story against VV Mineral and you will publish the same before 20th as, a case is listed in the High Court on 20th, so to prejudice the judiciary according to your commitment, you have to publish some story against VV Mineral before that.  That is why now you are asking the story relating to February. What can we do. ?

Peoples like you who are preparing story for money yourself told that you are fair journalist.

I have one more information. We have asked certain information from the District Committee. Since they have no reply, they did not furnish the reply. Appellate authority also did not furnish reply. When information commission give specific direction to furnish reply within 30 days, then also they did not furnish reply. Ask them to furnish the said information to you. So that you can find out that, all the complaints are relating to other companies and the order passed against VV Mineral was with ulterior motive without following the principles of Natural Justice or law, regulations or procedures,. Can you ready to publish under which provision the District Committee has the power to set aside the royalty fixation order. Whether the committee constituted  a committee in 2015 has the power to decide the issues 10 year prior to the constitution? Does the law permit this? If you are conscious people can you ready to raise this?

We request personal hearing and to inform when we have to furnish reply vide our letter dated 12.10.2016 which was received by him on 13.10.2016. Let him produce any evidence or document that, the District Committee asked or called or send notice to VV Mineral about the proposed action or meeting etc.,. Are you guts to write about that the District authority violated the principle of Natural justice. I know you will not do. Because you people are writing for money.

1) What is your reply to the finding of the Tirunelveli District Level Committee at a meeting on February 14, 2017 that two companies owned by Mr Vaikundarajan - VV Mineral and Transworld Garnet India - had unlawfully transported, during  2000-01 to 2007-08, about 9.82 lakh tonnes and 9.72 lakh tonnes of raw sand respectively (out of a total of 33.59 lakh tonnes) and 7 seven lakh tonnes of beach sand minerals (garnet, illmenite, rutile and zircon) and 1.11 lakh tonnes of the minerals, (out of a total of 16.69 lakh tonnes) ?

2) What is your response to the decision of the committee to treat, as null and void, the royalty settled by your companies along with a few others ?

3) Have you approached the State Level Appellate Forum against this decision?

4) Have you got any relief from the State government or any other forum against the decision of the District Level Committee in November 2016 that V.V. Minerals was guilty of transporting 9.65 lakh tonnes of heavy minerals during 2014-15 and 2015-16 ?

Tirunelveli: The court commissioner, Satyabrata Sahoo assured the workers of the beach mineral mining companies that he would not submit his report to the Madras high court without hearing their side.
Mr Sahoo, who has been appointed by the court to assess the stock of the beach mineral sand in the southern districts during his visit to one of the beach mineral factories at Vallanvilai in Radhapuram taluk was surrounded by around 500 labourers, who complained that the blanket ban imposed on beachmineral mining companies in the region deprived them of their basic livelihood.
The workers too complained that the district collector, M Karunakaran, who was present on the occasion, has been acting with personal motive in the issue.
Some of the higher officials of the beach mineral companies too added that the district collector deliberately refused to hear their side before taking action.
This, according to P S Kannan, manager of V V Minerals "may have hands of their global competitors from China" as V V Minerals, which stood first in the global garnet market an year ago has been pushed to the 18th place globally. Kannan also alleged that at the district level committee meeting, their company's complaint was not properly heard.
Receiving the four-page petition from the workers, the court commissioner, Mr. Satyabrata Sahoo promised the workers and officers of the beach mineral companies that he would not finalise any report without hearing the versions of both the companies and the workers.
The workers too have tactically warned of taking up series of demonstrations if their problems were not properly settled and the beach mineral companies reopened without redressing their issues.

Though we know that, this is also part of her work to prejudice the judiciary, for which she has get huge amount from our competitors and this Mafia Gang in which Sandhya and Retd. In fact, Sandhya Ravishankar is gang member who are threatening industrialist in a modern way and demand money. They all are criminals.  Retired IAS officers and IPS officers also in the part of gang.  They will collect money and share among them. A small portion is spend to the fellow reporters and some digital shell media’s. Some printed media’s who did not receive any advertisement from Mr.S.Vaikundarajan group companies also joined with them. The officers who are in service also by misusing the power do some wrong. A sizeable gang joined hands and is continuously harassing VV Mineral and its owner Mr. Vaikundarajan.

This gang operates FOR MONEY  comprises of VVM competitor Daya Devadas, an ILLEGAL MINOR, and retired government officials like Ramanujam, IPS, Sundaram, IAS, Prof.Victor Rajamanickam, Danuskodi Adithan, EX.Central Minister and also some officers in power. Sandhya Ravisankar joined this gang through her close friend Radhika, daughter of Sundaram. The above combo of rivals of VV Mineral with paid news writers Sandhya Ravisankar and more freelancers, brings up false allegations against VV Mineral. The ultimate motive is to spoil the fame of Mr. Vaikundarajan and to destroy his business and to prejudice the judiciary as well as Government against VV Mineral.  Sandhya’s Husband company delta4cast  demand some contract in News 7 Tamil which is not awarded. This personal enmity also one of the reason.

Sandhya Ravisankar has been continuously placing false allegations against VV Mineral, without any proof. Her article is fully based on her imaginations, false figures and a TOTAL COOKED UP STORY. VV Mineral have expressed its objection by mail and also filed a criminal case CC 37/2016 with Judicial Magistrate, Tirunelveli. VV Mineral has soo many proofs, which shows the motive of Sandhya Ravisankar. The proofs will be submitted in the court when the case comes for hearing.

Sandhya Ravisankar, wisely brings up something against VVM to the public, whenever VV Mineral's case is expected for hearing. The motive is to prejudice the judiciary and thereby get negative order against VV Mineral. Since forth week of March, there is a case listed, to prejudice the judiciary as well as the Government, she has created this false news.

By this article, Sandhya Ravisankar is trying is keep the flame alive, which she lighted against VV Mineral and by shedding crocodile tears that she has been harassed, she targets to earn sympathy of innocent readers.

Sandhya Ravisankar has made vague statement that "most mainstream newspaper and publications are afraid to write on this subject". She pursumed that, she is the ONE AND ONLY BOLD JOURNALIST. So many journals have published stories against VV Mineral. When we send them the replies, they were satisfied, carried our replies and published them too. Already Sandhya published a false news in the Economic Times, when we send reply they themselves accept that, the facts are not verified and published clarification available in goo.gl/oIYJ1

VV Mineral has sent so many replies to "THE WIRE" and also to Sandhya Ravisankar, which were NEITHER CONSIDERED NOR PUBLISHED. This shows that Sandhya Ravisankar is working only with a MOTIVE. Instead of responding to the questions, now she has resorted to the tactics of cornering sympathy waves by giving a MASALA ARTICLE.

There is no fault with VV Mineral and it is always operating as per the rules and regulations of the Government. VVM will prove this and come out of all such allegation very soon.

In the Mafia Gang, some Retired IAS, IPS officers also members including Mr.Ramanujam, Retd. DGP. Ramanujam and Sandhya Ravishankar will regularly meet in a coffee shop namly ANOKHI CAFÉ opposite to Park Plaza Hotel in the smoking zone and they prepare the criminal plan. We are having sufficient evidences and we instruct our advocates to file criminal complaints against Sandhya as well as Ramanujam. By smelling the same, Sandhya has created this story in advance. Motive for the Tirunelveli District Collector Karunakaran's Press Release on 23.02.2017

M/s.V.V.Mineral having  about 98 Lakhs tonnes of minerals transported to factories that was legally paid royalty and obtained transport permit since 2001.  These all were confirmed by the previous District Collector and the royalty reconciliation orders were also passed.  From the above stock, we have still exported 58 Lakhs tonnes and have the balance about 40 Lakhs tonnes.  These accounts have been directly verified by  the central and state government officials  and that  report has been submitted to the central and state governments.  The District collector, Tirunelveli has joined hands with some of our competitors and with ulterior motive,  he has cancelled  the orders issued by the pervious collector without any powers, further he wrote to customs authorities to stop the export without his NOC.  Though  we have royalty paid stock, he has pass the said order only to give trouble to VV Mineral.   Mr.Karunakran has made a press release mentioning the above only to damage our reputation and to help our competitors. The orders issued by the previous collector can be changed or made correction only by the higher officials, not by the succeeding Collector, this legal position can be even known to the illiterate. 

Does the Mines Act or Rules confer any power to change this? If so, whether Mr.Karunakaran is ready to explain specifically with the Section of the Act and Rules? It is not fair to do a press release from the higher official stating that the minerals were transported without transport permits and exported them illegally without any basis. Truly speaking that the transport permits are not compulsory and if any person applies for the transport permits, it should be given – this is specifically mentioned in the lease granting order.   As per our company’s request for transport permit, the Govt. wrote a letter with some guidelines. Subsequently the Central Govt. amended in the MMDR Act and Rules so this guidelines became infructuous.   The Commissioner of Geology and Mining informed this legal position to the Govt. and in turn the Govt. also sent a letter to the District Collector and other officials  on 31-07-2003. Hence as on date, the transport permit procedure is not in force in respect of major minerals.

 Export of minerals does not comes under the purview of State Government.  It is only related with the Central Govt.   The Central Govt. has already informed that the Export of minerals does not come under the purview of MMDR Act.    If the supreme power (?) collector doesn’t  accept this, what can do we the normal people?. All of know about the condition of our judiciary system and we can’t expect immediate  justice in the country like India. Inspite of knowing all this position, some of the higher officials have been passing such type of illegal orders.   But at last the justice will own.

The collector has said that he has taken the action for not having obtained the license from the Panchayat and the High Court of Madras has ordered to fetch proper permission with taking consideration of order issued for the other companies.   A review petition is filed in this regard before the Honourable High Court Madras.  In fact, this activities does not comes under the purview of Factories Act and this has been declared by the competent Court, in which the District Collector also the First Respondent.   So this fact is well known to the District Collector.  The collector clearly hides the true fact and with ill-motive, he has issued the order. The Collector openly declared that, everyday he will issue different orders against VV Mineral and he has said that no one can take action against him as, he is part of government.  We the normal business company can’t do anything against the supreme power collector. 

The motive for the collector to issue a press release is that the allegation made by the Tirunelveli district collector has been sent to us by one reporter Mrs.Sandhya Ravishankar who is assigned work to write against us and a close friend of the collector.   We replied to Sandhya on 20-02-17 that we planned to take criminal action  against the District Collector .  To prejudice the judiciary in a case pending in the Honourable High court, the District Collector has made a report by wantonly organizing a meeting on 14-02-17 stating  that our company has illegally mined the minerals during the period of 2001 to 2007 and that report has been virally sent in the social media by the District Collector.  This details have been known to us from some of the reporter. 

According to law Collector can pass orders only after following the below mentioned procedures that,
1)    Collector has to send a letter asking explanation mentioning the particular specific allegations against us and the proposed actions to be taken against us.
2)    Collector has to furnish copy of documents to establish his allegations.
3)    Collector has to get written explanation from us.
4)    Collector if not convinced in our written explanation, or he need further details he has to inform us in writing by giving sufficient time.
5)    Before passing order he has to give personal hearing. This guidelines have been framed by the Honourable Supreme Court under natural justice.
But in this case, the District Collector without following any procedures, with ulterior motive, cooked orders against us and hand over the same at first to Sandhya Ravisankar and to his other media friends.  When we know about this, our company made decision that , why should we bather about the illegal order issued by the collector without following any procedures that too, without receiving copy of orders.  But Mrs.Sandhya who has nexus with Karunakaran has mailed to us. In that mail, certain questions have been raised by her.  While replying her questions, we further added a few points regarding the allegation made by the Tirunelveli district collector and the proposed criminal action against the District Collector on 20.02.2017. The above details and mail can be viewed in the blog http://vvmemp.blogspot.in/2017/02/blog-post.html.  Immediately, Sandhya discussed with his close friend Mr.Karunakaran, District collector and direct him to send order copy. So the district Collector issued the said order on 20.02.2017 and that order has been sent to our company and other related companied also. We have got the copies of the same order (1) dated 14.2.17 which was spread by District Collector on Whatapp and (2) dated 20.2.2017 send to us.  We have requested some information under RTI Act. The collector clearly knows that the legal action can be taken against him, if the details are provided to us under Right to information Act.  So these details have not been provided or refused to give us as of now.  So we made appeal before the Information Commission and it is now pending with them.   We will go according to law and we don’t  try or indulge in any overwhelming. 
After Seeing the Collector’s Press release, we enquire about the face book and whatsapp messages,  none of them is not relevant to mineral sand. But it is relating to issuance of arms license without police report and giving one side support to some particular people etc., Since he is the Head of the District Administration, all the sub-ordinate officials will give different complaints and they may put signature, whatever minutes he create without following the Act and Rules. Whether they mentioned the particular Act, Rules, Section, Notification or any other provisions of the Act and Rules? 

An ordinary layman after reading the news in whatsapp against the District Collector, asking that why the district collector make police complaint instead of refuting allegations levelled against him.   Further they felt that, the FIR by District Collector shows that, he afraid of the allegations against him should not come out.  But we neglect it.   Our company follows all the Act, rules and procedures and we will never violate anything. Our competitor has formed a specific group for spreading fake news about us. If the collector Mr.Karunagaran issued the orders by following the  procedure and law ask him to furnish the below  four details either by Whatsapp or press release.
1)    When Collector issue notice to us mentioning specific allegation / violations against us and the proposed action to be taken against us.
2)    When Collector furnish copy of documents supporting the specific allegation / violations against us, ask him to list out the specific allegations against us.
3)    When Collector has submit written explanation after furnishing copy of documents.?
4)    Whether Collector replied to our letter dated 12.10.2016 asking them to inform the enquiry date to furnish reply or to inform the date of personal hearing to appear in person to furnish reply and explanation?
If  Collector furnish the above details either by Whatsapp or press release the ill motive for passing the illegal order will come to light.

In fact, we wrote a letter to the collector on 12.10.2016 by RPAD. On the above said letter we have mentioned that, our enemy and competitor two persons spread news in public that, the District Collector promised them to issue order against us and hence we request on which date, we have to submit our reply. We also specifically request to inform the personal hearing date. We are having the postal acknowledgement duly signed by the Collectorate officials. The Collector knows that, if he conduct personal hearing and get reply from us, he cannot pass illegal order against us. So without getting reply and without giving personal hearing he pass order on 9.11.2016.  Will he be ready to prove that the personal hearing has been given to us vide our letter dated 12-10-16?

As per the Limitation Act, the order issued before 3 years cannot be reviewed or modified or cancelled at any situation.  According to Income Tax Act, the orders mentioned before 5 years cannot be interfered.  As per the MMDR  Act,  the orders issued by an officer cannot be reviewed,  changed or cancelled by the same authority or by the State Government. It can be changed or modified or cancelled only by the Central Govt. in respect of major minerals. In our case, without any power, but with ulterior motive and to create problems to us, the Collector pass orders for the activities of the year 2001-2007, after 17 years, that too without following the procedure and without hearing the party.  

The orders were immediately send to some particular media people to spread news against us. Is it fair?  Is it not punishable under criminal law?

Investigation has  to been made on this or not?
Mr.Vaikudarajan has mailed to the reporter Mrs.sandhya on 20-02-17 that the criminal case will be filed against Mr.Karunakaran, who received this mail from Sandhya on the same day and he has wantonly create documents to defend  Mr.S.Vaikundarajan proposed criminal case. That is why he immediately issue press release.

How did the government letter dt. 14-02-17  go to sandhya?  who gave it?

Will the collector ready to face the CBI investigation regarding this scam and the nexus between them? 

The press release clearly indicates the nexus between the reporter Mrs.Sandhya and the collector Mr.Karunakaran.

The allegation report about the collector which gets posted in the social media, no longer related to mining issues. There are not at all involved by our company and Mr.Vaikundarajan about this news spread in the social media.   The press who are not getting the advertisement from VV Group of companies and those who needs the support from the District Collector have given top most priority to this news.
